3、权力行使方式特定性、被动性与主动性兼具、权力效力的普遍性 等特征。由于法律稳定性与社会情势易变性固有矛盾的存在，最高人民法院和最 高人民检察院需要制定大量的刑法司法解释，以适应经济社会生活的发展，满足 刑事司法实践的需求， 而刑法司法解释得以产生的内在动因在于刑法司法解释权 的运作，刑法司法解释则是刑法司法解释权运作的最终表现形式。随着我国法治 建设进程不断向前推进， 刑法司法解释权的地位和作用在司法实践中逐步提高和 进一步增强。一方面刑法司法解释权在克服刑法条文的抽象性和模糊性，维持刑 法的安定性以适应社会经济发展方面具有重要作用； 另一方面对防止刑事司法裁 量权的滥用、确保法制的统一具有重大意义。然而由于各主体之间的利益纠葛、 权力具有天生的扩张性等各方面因素的影响， 导致刑法司法解释权的运作存在诸 多问题。首先，刑法司法解释权的行使主体混乱，其结果造成实际解释权主体的 多元化，行政机关、最高司法机关内设业务部门及地方司法机关不断蚕食刑法司 法解释权；其次，刑法司法解释权运作程序弱化，最高司法机关自定权力运作规 则，有违正当程序原则，权力运作隐蔽，有悖公开性、民主性原则；再次，刑法

4、 司法解释权运作与刑法的基本原则相背离，不断侵入立法权领域；最后，当刑法 司法解释权的运作遭遇前述问题时无法得到及时有效的纠正。 从我国目前的有关 法律规定来看， 虽然我国建立了相应的刑法司法解释权运作监督机制，但是还不 够全面、完善，甚至一些有效的监督制约机制被束之高阁，导致刑法司法解释 权的行使更加“肆无忌惮”。因此，有必有从理论上在加以研究、探讨，以寻求 最佳的解决方案，实现刑法司法解释权的规范化运作：第一， 规范刑法司法解 释权运作主体，禁止无权主体制发刑法司法解释，禁止以颁布司法规范性文件之 名行制定司法解释之实，禁止地方司法机关制发刑法司法解释性文件。第二，完 善刑法司法解释权运作程序，使解释权运作程序步入法律化、制度化、规范化的 轨道，在刑法司法解释公布实施前向社会公众征求意见，以保障刑法司法解释权 运作的公开性和民主性，实现程序制约权力。第三，刑法司法解释权的运作必须 遵循刑法的基本原则， 通过罪刑法定、 罪责刑相适应、 刑法面前人人平等的原则， 实现法律制约权力。第四，强化刑法司法解释权运作的违法监督机制，严格执行 刑法司法解释的违法审查机制，完善刑法司法解释权运作监

6、ecause of the existence of the Inherent contradictions between the stability of the law and social situation,the Supreme Peoples Court and Supreme Peoples Procuratorate need to develop a large number of judicial interpretations of criminal law, in order to adapt to the development of the of life economic and society, and to meet the needs of the criminal justice practice, the judicial interpretation of criminal law to be generated within the vivid result of the operation is that the power of jud

7、icial interpretation of criminal law, and judicial interpretation of criminal law is the ultimate manifestation of the operation of the judicial interpretation of criminal law. Constantly pushing forward the process of rule of law in China, the status and role of the power of judicial interpretation criminal law do gradually improve and further enhanced in judicial practice. The one hand, the power of judicial interpretation of criminal law to overcome the abstraction of the provisions of the pe

8、nal code and fuzziness, maintaining the stability of the penal code to adapt to the economic-society development has an important role; On the other hand,there iis of great significance to prohibit abuse of criminal discretion, to ensure the unity of the legal system. However, owing to the conflicting interests between the main power and powers inherently expansionary various factors, led to being many difficulties in the operation of the power of judicial interpretation of criminal law.
