广西师范大学硕士学位论文历史文化名城保护与开发的中外法律制度比较研究姓名：袁芳申请学位级别：硕士专业：国际法指导教师：杨丽艳20080401II历史文化名城保护与开发的中外法律制度比较研究 学科专业：国际法 研究方向：国际经济法 硕士研究生：袁芳 指导教师：杨丽艳 教授 摘 要 我国的历史文化名城，体现了中华民族悠久的历史与灿烂的文化在城市高速发展的今天，历史文化名城的保护正处在非常时期历史文化名城命运的关键就在于如何实施保护与开发的有机统一，因此，对历史文化名城保护与开发法律制度的研究具有十分重要的意义本文采用了历史分析、比较分析与系统分析等多种研究方法，对历史文化名城的相关概念进行了界定，对我国历史文化名城保护制度进行了梳理，对历史文化名城国际保护及英国、日本、法国等发达国家的保护制度进行介绍，并就我国历史文化名城保护与开发法律制度的完善提出了相应的措施正文共分为四个部分： 第一部分是对历史文化名城保护与开发的一般分析该部分主要进行基本理论分析介绍了历史文化名城的含义、历史文化名城概念的级别及与国外相关概念的比较、历史文化名城的特征、保护与开发历史文化名城的意义 第二部分论述了我国历史文化名城保护与开发的法律制度。

叙述了我国历史文化名城保护法律制度的确立过程，总结了历史文化名城保护的内容与原则详细介绍了我国历史文化名城保护的法律制度体系、行政管理体系、规划制度与资金保障制度指明了我国历史文化名城开发的原则、方式，并得出历史文化名城保护与开发应协调进行的结论 第三部分分析了历史文化名城保护与开发的国内外借鉴 首先介绍了历史文化名城的国际保护，其次介绍了英国、日本、法国等国家的历史文化名城法律保护，最后将中外历史文化名城保护与开发法律制度进行比较 第四部分指出了我国历史文化名城保护与开发中的不足， 并针对这些不足提出了应该如何完善提出应该调整历史文化名城保护的行政主管部门，建立动态审批制度，完善政府对历史文化名城保护规划的编制， 合理划分保护规划的审批权限， 完善资金保障制度，同时正确处理好保护与开发的关系，走可持续发展的道路 关键词：历史文化名城 保护 开发 比较研究 IIIThe Comparative Research on the Chinese and foreign legal system of Historical and Cultural Cities’ Protection and Development Abstract China's historical and cultural cities， reflect China has a long history and splendid culture．With the rapid development of the city today，the protection of the Historical and Cultural Cities is in an extraordinary period．The key point of the destiny of the Historical and Cultural Cities is depending on how to unify protection and development organically．So，the research on the legal system of Historical and Cultural Cities is very important．The issue makes a definition on the concept of Historical and Cultural Cities，combs the system of China’ s Historical and Cultural cities ’ protection ，introduces the international protection of Historical and cultural cities and puts forward the corresponding countermeasures on perfecting the law system of China’ s Historical and cultural cities’ protection by adopting such methods as historical analysis，comparative analysis，systematic analysis，etc．This thesis consists of four parts： Part one is the general analysis of Historical and Cultural cities’ protection，which mainly puts emphasis on the fundamental theories． This part introduces the meaning of Historical and Cultural cities，the concepts of Historical and Cultural cities and foreign- related concepts，the characteristics of Historical and Cultural cities and the significance of protect and develop the Historical and Cultural Cities． Part two analyzes the status quo of the law system of China’ s Historical and Cultural cities ’ protection and development．This part describes the established process of China’ s legal system to protect the Historical and Cultural Cities，includes the subject of the Historical and Cultural cities’ protection，the administrative system，planning system and capital security system，etc．And the protection of Historical and Cultural cities should be coordinated with development． Part three analyzes the use for reference in home and abroad on the legal protection for Historical and Cultural Cities．First of all ，it introduces the international protection of Historical and Cultural Cities，then，it analyzes protection for Historical and Cultural Cities in England，Japan，France，etc．At the end，it compares the Chinese and foreign legal system of Historical and Cultural Cities’ Protection and Development． Part four expounds the perfection of the law system of China’ s Historical and Cultural cities．The administrative department of Historical and Cultural cities’ protection should be IV adjusted，the dynamic system of examination and approval should be established，in the planning system of Historical and Cultural cities’ protection，the workout of the rules made by the governments for protecting the Historical and Cultural cities should be improved，the financial security should be improved．At the same time，Correctly handle the relationship between protection and development，follow the path of sustainable development． Key Words: Historical and Cultural Cities Protection Development Comparative Research 41论文独创性声明 本人郑重声明：所提交的学位论文是本人在导师的指导下进行的研究工作及取得的成果。
