CMAC船舶碰撞仲裁协议（中国海事仲裁委员会1994 版）政府示范文本要点船舶事故双方同意将船舶碰撞产生的争议提交中国海事仲裁委员会裁决CMAC船舶碰撞仲裁协议中国海事仲裁委员会（1994 ）标准格式China Maritime Arbitrati on Commissi on Stan dard Form（1994）年月日代表号船舶（船旗国：船籍港：）（地址：：：电传：邮政编码：)同代表号船舶（船旗国：船籍港：）（地址：：电传：：邮政编码：)(或者）代表的财产所有人）（地址：：电传：：邮政编码：）达成协议如下：第一条双方当事人同意将号船舶同号船舶于年 月 日时（格林尼治时间或北京时间）在地方发生碰撞而产生的一切争议，包括当事人应负的责任和有关赔偿损失的金额， 提交中国海事仲裁委员会裁决第二条为请求赔偿的损失进行财产保全，双方冋意由 于 年 月 日前向提交 保全金或担保；由 于年 月日前向 提交 保全金或担保当事人按照本条第一款规定向对方提供担保并不视为已承认碰撞责任 如果当事人提供了完全符合第一款规定的担保，另一方不得向法院申请扣押对方所拥有的船舶和财产第三条 如果双方对本协议第二条 第一款没有达成协议， 或者虽然双方达成协议， 但一方没有收到对方提供的担保，或者担保逾期失效，本协议第二条 第三款将不适用。

The provisi on in Paragraph 3 of Clause 2 hereof shall notapply in abse nee of an agreeme nt betwee n the parties as prescribed in Paragraphl of Clause 2 hereof, or in the ease that a party fails to receive the security from the other party,though agreeme nt has bee n reached betwee n the parties, or that such security as has bee n provided becomes in effective due to expirati on.4. The parties agree that one party con duct survey to damage to the vessel or property owned by the other party and provide convenience for survey to be held by the other party.s Republic of China5. The arbitratio n procedure shall be gover ned by the Rules of Arbitrati on of China Maritime Arbitrati on Commissi on and the award made by the Commissi on shall be final and binding on the parties.6. Except as otherwise expressly provided,the law of the Peopleapply to this Agreeme nt and to the arbitrati on con ducted un der this Agreeme nt.7. A ny cha nge of the n ame, address, fax and telex nu mber and postal code give n in the preamble of this Agreeme nt shall be immediately com muni cated to the Commissi on and the other party.
