澳大利亚同性婚姻合法化探析（摘要） 随着世界多元文化的发展，同性恋作为一种亚文化日益被民众了解和接纳民众对同性恋的态度也渐渐发生着变化在澳大利亚大多数人都支持同性恋平权的大趋势下，现有的婚姻制度无法保证同性恋群体缔结婚姻的权力，此时婚姻制度面临变革的压力澳大利亚同性婚姻的合法化历程具有独特的代表性，走的是和英国一样的先建立类婚姻制度也就是事实伴侣制度作为保障同性伴侣权力的一个过渡，再到全面实现同性婚姻合法化的道路澳大利亚通过对其传统的婚姻法进行修改,把同性恋群体纳入到可以缔结婚姻的范围内来调整而在同性婚姻合法化的过程中,经历了几次影响深远的事件，其中标志性的事件是1999年新南威尔士州的《事实伴侣关系法》修正案（Property (Relationships)Act 1984 (NSW)）颁布，它将同性伴侣纳入财产分割和其他领域的同时，对事实伴侣关系（de facto Relationship）做出了全新的定义，指的是两个人未婚的人以家庭名义共同生活的关系，修改了之前规定事实伴侣关系仅适用于异性之间，法律正式认可了同性事实伴侣关系在2017年8月8日澳大利亚宣布对是否同意同性婚姻合法化进行全民公投，为2017年12月7日实现同性婚姻合法化提供了一定的民意基础。

通过分析澳大利亚等国的同性合法化路径从而思考同性婚姻合法化的意义以及对我国的启示导论介绍了澳大利亚同性婚姻合法化相关主题的研究现状正文的第一部分论述的是在澳大利亚同性婚姻合法化前，事实伴侣的法律化以及通过对事实伴侣关系定义的扩张使得同性伴侣也能得到合法保护的过程并介绍了事实伴侣的成立、解除及关系解除后其财产分配的相关法律规定；第二部分论述了澳大利亚同性婚姻合法化的进程中，政府开展了关于是否同意同性婚姻合法化的全民公投，引发了多方对其宪法意义上的争论，并显示了同性婚姻合法化有着广泛的民意基础；第三部分论述了澳大利亚2017年《婚姻法修正案》(Marriage Amendment (Definition and Religious Freedoms) Act 2017 ))的提出，法案的审议与通过，并针对法案内容进行评析，探讨澳大利亚实现同性婚姻合法化的价值基础和实践效果：第四部分对澳大利亚同性婚姻合法化的路径进行了分析，总结了英美法系国家同性婚姻合法化的特点，并探求澳大利亚同性婚姻合法化路径的意义，提出为什么一定要从保护同性伴侣关系过渡到同性婚姻的思考结语部分探讨了同性婚姻合法化路径的选择，结合我国国情探讨同性婚姻合法化趋势对我国同性婚姻立法带来的启示。
