    • The Organic Crop Improvement Association International, Inc. (hereinafter referred to as “OCIA Japan”), having its administrative office and mailing address at: 美国有机作物改良协会所设立的办公室(以下简称“OCIA日本”)和联系地址为:Tsuruya-Kato Bldg. 3A, 4-21-7 Shinbashi, Minato-ku, Tokyo 105-0004, JapanAddress of Business Entity: 申请单位地址:Name of Business Entity申请单位名称 Type of Business [Corporation, LLC, PC, etc.] 申请认证单位性质[公司/民营](such business entity being hereinafter referred to generally as “Associate”). OCIA Japan and Associate, intending to be legally bound, hereby agree as follows: (以下申请认证单位通常简称为会员)OCIA总部和会员签署如下协议:1. DEFINITIONS 定义As used herein the following terms, including plurals and variants thereof, shall have the meanings stated:协议下文所用术语定义为:1.1 MAFF — Ministry of Agriculture, Forestry and Fisheries of Japan. MAFF—日本农林水产省1.2 JAS — Japan Agricultural Standards for organic agricultural products and organic processed foods. JAS—日本农业标准中的有机生产和加工食品1.3 Seal — The acronym “JAS” and the symbol “JAS logo”. 标志—JAS缩写和JAS标记。

      1.4 Label — Any written, graphic or printed material placed on a container/package, or a statement accompanying a product (such as on a document).标签—所有书写,图解或印刷在容器/包装,或与产品一起(如文件)上的材料1.5 Law — The Law Concerning Standardization and Proper Labeling of Agricultural and Forestry Products, Law 175 of 1950. 法律—1950年175号颁布的农林产品恰当使用标签的规定1.6 Technical criteria — Technical Criteria of Certification of Production Process Management Director Concerning the Organic Agricultural Products, Notification 1830, 1831, and 1832 of MAFF. 技术标准—MAFF颁布的1830,1831和1832中关于有机农产品生产管理过程认证技术标准。

      1.7 Enforcement Regulations — Enforcement Regulations of the “Law”, Ministerial Ordinance 62 of 1950. 实施细则—农林水产省1950年62号“法律”实施规范1.8 Standards — Japanese Agricultural Standard of Organic Agricultural Products, or the Japanese Agricultural Standard of Organic Processed Foods, Notifications 1605 and 1606 of MAFF, respectively. 标准— MAFF颁布的1605和1606告示中关于日本有机农产品农业标准,或日本有机加工食品农业标准2. ASSOCIATE’S PERFORMANCE OBLIGATIONS 会员履行的义务2.1 Associate shall follow the regulations of the JAS law and the regulations of certification body based on the JAS law. 会员应当遵守JAS规定,同时也应遵守认证机构根据JAS制定的管理规定。

      2.2 Associate shall provide unlimited access to the operation and maintain organic certification documents and records, including a copy of this agreement, for at least three (3) years so that they can be examined and/or sampled during annual, unannounced, and/or verification inspections by authorized OCIA representatives, public officials, or OCIA inspectors. 会员不得限制进入其经营场所,同时有机认证管理文档(包括本协议)至少应保留三年,以便接受OCIA授权代表、管理官员或OCIA检查员在进行年度例行、未通知和/或验证检查和/或抽样2.3 After certification, the Associate shall correctly use/display the JAS seal and appropriately state that s/he is a certified Production Process Manager.有机认证后,会员应当恰当使用/粘贴标签,并正确标识其为获得有机认证的生产过程管理者。

      2.4 Whenever a certified Associate/certified operation divides their certified operation into separate entities, or acquires/inherits another distinct operation, the certification shall terminate and re-certification to JAS will be required. 一旦获得认证的会员/经营场所分为不同的独立单元,或获得/继承其它不同生产单元,本认证立即终止,并须重新申请JAS认证2.5 Must submit valid copies of labels that are used or intended to be used on JAS certified products from the operation and resubmit labels every time the operations modifies the design of the package or the label for approval by the certification body.必须向认证机构提供正在使用或即将使用在获得JAS认证产品上的有效标签样本,而且每次更改包装标签设计时,也必须重新提供标签样本以便进行审核。

      3. THE REQUIREMENTS IN RELATION TO THE MINISTERIAL ORDINANCE No.62 Article 46 (1)(IV) 关于MAFF62号法令46 (1)(IV)要求After certification, the associate shall comply with following. 获得有机认证后,会员必须遵守如下规定:3.1 Associate shall maintain all documents/information concerning JAS certification to comply with the Technical Criteria of Certification. 会员应当保留与有机认证有关的文件信息,以证明生产管理是符合有机认证技术标准的3.2 Associate shall observe the regulations concerning JAS labeling as required by JAS standards and JAS law.会员应当遵守JAS标准法律中关于JAS标签管理的规定。

      3.3 Associate shall comply with any mandate concerning JAS labeling that is ordered by the Minister of Agriculture, Forestry and Fisheries (below, MAFF); Associate shall submit any requested information and shall ensure all information is truthful when a report is requested by MAFF or Center for Food Quality, Labeling and Consumer Services (below, CFQLCS); and the Associate shall not deny, disturb nor evade an on-site inspection by MAFF or CFQCLS.会员应当遵守MAFF颁布的所有关于标签管理的强制性规定;会员应当根据MAFF或食品质量中心的要求提供所有信息材料,并保证信息材料的真实性;而且会员不得拒绝、阻碍或逃避由MAFF或CFQCLS指定的现场检查。

      3.4 Associate shall give advance notice to the certification body whenever a change to an item stated in the application and its attached documentation is made, or when the Associate will discontinue the JAS grading procedures as currently written. 一旦申请材料(含附件材料)中所描述项目有所变化,或书面终止达规判定规程,会员应事先通知认证机构3.5 Associate shall not provide misleading information according to the certification system of the certification body, use of license a。
