1、从词源、专门术语等方面看法律英语及其用词特征-法律英语专业论文 摘 要 从词源、专门术语及全民共同语中一般词汇的使用等方面分析了法律英语 的用词特点,旨在概览法律英语这一在常规英语语言基础上变异而成的专业英语的语言风格 特点,在理论上指导法律英语的学习、研究和实践。 关键词 法律英语; 词汇; 特点 中国成功加入 WTO 以及国际交往的日益频繁,急需能使用英文进行商务活动和法律执 业的律师。作为一名国际律师、律师助理或法律顾问,出色地掌握法律英语是必备前提。法 律英语是指人们尤其是法律工作者、法学家用于法律科学概念以及用于诉讼和其他法律事 务时所用的有别于其他语体的英语语体。作为一种具有规约性的语言分支,它有其独特的语 言风格特点,包括语篇结构、语法句法选择、词汇使用等。本文拟就法律英语中的用词特点 来管窥其语言特点之一斑。 一、词源 英语词汇的来源最具开放性,法律英语词汇亦是如此,古体词、外来语是其主要词源渠道。 1、古体词 在法律英语中,旧词、古词和十分学究气、正式的词的使用远非其他任何文体之语言所能及。 大体上,在诺曼人征服英国之前直到公元 1100 年的英语称为古英语;公元 1
2、100 年到 1500 年的英语称为中世纪英语;1500 年以来的英语称为现代英语。法律英语保留了古英语和中 世纪英语的词汇和很久以来脱离了普通用法的意义。如:aforementioned (=previously mentioned )(括号内是当代英语的表达方式,下同)aforesaid (=above), forthwith(=immediately), henceforth (= from that time on / from now on / after that), hitherto (until this time / up to now),pursuant to (= under / according to), thence(=from there/from that place, time or source/for that reason), to wit (=namely/that is to say), whence (=from where)。这些词对大多数非法律工作者是罕见的,可对于法律工作者,却是他 们的家常便饭。再如与 here 组合的词:herea
3、fter, here before, hereby, herein, hereof, here-tofore, herewith, hereinabove, hereinafter, hereinunder, hereunder;与 there 组合的 词:thereabout, thereafter, thereat, thereby, there-from, therefor, therefore, therein, thereof, thereon, thereto, thereunto, theretofore, there-upon, therewith;与 where 组合的词(特别是 在陈述事实、证明契约等时): whereas, whereat,whereby, wherefore, wheresoever, wherein,whereof, whereon, whereupon 等等古词、旧词,在法律英语中使用得较多。 2、外来语 由于历史的原因,当代法律英语中外来词语的借用十分普遍,主要是法语和拉丁语。法语对 法律英语词汇的形成产生过直接的巨大作用。在 1066 年
4、诺曼底人征服英格兰之后,法语中 大量的法律术语词汇被借用到了法律英语中。其中一些已经融入英语词汇,如 insurance, attorney, plaintiff, plead, dependant, equitable, dossier, dispose, disclose, arrest, assault, contract, damages, heir, larceny, mortgage, reprieve, treason, trespass 等等;另一些仍保 留了法语外貌,如 alien or aliene (= to convert or transfer“转让、让与授予权”),feme covert (=a married woman“有夫之妇,已婚女子”),cestui que trust (=beneficiary“信托收益人”),cy-pres(=as near as possible“尽可能地,近似原则”),enventre sa mere (=in its mother s womb“腹中胎儿,待生胎儿”),seisin / seizin (=possessi
5、on or ownership“依法占有”)等。 拉丁语是法律英语词汇的另一个重要来源。由于基督教于公元 597 年传入英国,拉丁语法律 词也渗入到英语中来。在法律英语中存在着大量的拉丁词汇,其中有些已经融入了英语词汇,如 果不仔细研究其根源,很难发现其拉丁属性。如:declaration, register, convict, detention, jury,omission, litigant, felony, offence, injury, compensate, negotiate, derelict, affirm, appellate,deprive 等。另一些则仍保留了拉丁语的外貌及其属性,让人一眼便知道其拉丁语 渊源。比如:jus retentiouis (=right of retention“留置权”),obligation solidaria (=joint obligation or jointdebt“连带债务”),beneficum appelandi (=right of appeal“上诉权”), condominus (=co-owner or ow
