7页国际民商事案件中外国判决的承认和执行公约TheStatessignatorytothepresentConvention,Desiringtoestablishcommonprovisionsonmutualrecognitionandenforcementofjudicialdecisionsrenderedintheirrespectivecountries,HaveresolvedtoconcludeaConventiontothiseffectandhaveagreedonthefollowingprovisions:CHAPTERICOPEOFTHECONVENTIONArticle1ThisConventionshallapplytodecisionsrenderedincivilorcommercialmattersbythecourtsofContractingStates.Itshallnotapplytodecisionsthemainobjectofwhichistodetermine?(1) thestatusorcapacityofpersonsorquestionsoffamilylaw,includingpersonalorfinancialrightsandobligationsbetweenparentsandchildrenorbetweenspouses;(2) theexistenceorconstitutionoflegalpersonsorthepowersoftheirofficers;(3) maintenanceobligations,sofarasnotincludedinsub-paragraph(1)ofthisArticle;(4) questionsofsuccession;(5) questionsofbankruptcy,compositionsoranalogousproceedings,includingdecisionswhichmayresulttherefromandwhichrelatetothevalidityoftheactsofthedebtor;(6) questionsofsocialsecurity;(7) questionsrelatingtodamageorinjuryinnuclearmatters.ThisConventiondoesnotapplytodecisionsforthepaymentofanycustomsduty,taxorpenalty.Article2ThisConventionshallapplytoalldecisionsgivenbythecourtsofaContractingState,irrespectiveofthenamegivenbythatStatetotheproceedingswhichgaverisetothedecisionorofthenamegiventothedecisionitselfsuchasjudgment,orderorwritofexecution.However,itshallapplyneithertodecisionswhichorderprovisionalorprotectivemeasuresnortodecisionsrenderedbyadministrativetribunals.Article3ThisConventionshallapplyirrespectiveofthenationalityoftheparties.CHAPTERIIONDITIONSOFRECOGNITIONANDENFORCEMENTArticle4AdecisionrenderedinoneoftheContractingStatesshallbeentitledtorecognitionandenforcementinanotherContractingStateunderthetermsofthisConvention?(1) ifthedecisionwasgivenbyacourtconsideredtohavejurisdictionwithinthemeaningofthisConvention,and(2) ifitisnolongersubjecttoordinaryformsofreviewintheStateoforigin.Inaddition,tobeenforceableintheStateaddressed,adecisionmustbeenforceableintheStateoforigin.Article5Recognitionorenforcementofadecisionmayneverthelessberefusedinanyofthefollowingcases(1) ifrecognitionorenforcementofthedecisionismanifestlyincompatiblewiththepublicpolicyoftheStateaddressedorifthedecisionresultedfromproceedingsincompatiblewiththerequirementsofdueprocessoflaworif,inthecircumstances,eitherpartyhadnoadequateopportunityfairlytopresenthiscase;(2) ifthedecisionwasobtainedbyfraudintheproceduralsense;(3) ifproceedingsbetweenthesameparties,basedonthesamefactsandhavingthesamepurpose?a) arependingbeforeacourtoftheStateaddressedandthoseproceedingswerethefirsttobeinstituted,orb) haveresultedinadecisionbyacourtoftheStateaddressed,orc) haveresultedinadecisionbyacourtofanotherStatewhichwouldbeentitledtorecognitionandenforcementunderthelawoftheStateaddressed.Article6WithoutprejudicetotheprovisionsofArticle5,adecisionrenderedbydefaultshallneitherberecognizednorenforcedunlessthedefaultingpartyreceivednoticeoftheinstitutionoftheproceedingsinaccordancewiththelawoftheStateoforigininsufficienttimetoenablehimtodefendtheproceedings.Article7RecognitionorenforcementmaynotberefusedforthesolereasonthatthecourtoftheStateoforiginhasappliedalawotherthanthatwhichwouldhavebeenapplicableaccordingtotherulesofprivateinternationallawoftheStateaddressed.Nevertheless,recognitionorenforcementmayberefusedif,toreachitsdecision,thecourtoftheStateoforiginhadtodecideaquestionrelatingeithertothestatusorthecapacityofapartyortohisrightsinothermattersexcludedfromthisConventionbysub-paragraphs(1)-(4)ofthesecondparagraphofArticle1,andhasreachedaresultdifferentfromthatwhichwouldhavefollowedfromtheapplicationtothatquestionoftherulesofprivateinternationallawoftheStateaddressed.Article8WithoutprejudicetosuchreviewasisrequiredbythetermsoftheprecedingArticles,thereshallbenoreviewofthemeritsofthedecisionrenderedbythecourtoforigin.Article9InquestionsrelatingtothejurisdictionofthecourtoftheStateoforigin,theauthorityaddressedshallbeboundbythefindingsoffactonwhichthatcourtbaseditsjurisdiction,unlessthedecisionwasrenderedbydefault.Article10ThecourtoftheStateoforiginshallbeconsideredtohavejurisdictionforthepurposesofthisConvention:(1) ifthedefendanthad,atthetimewhentheproceedingswereinstituted,hishabitualresidenceintheStateoforigin,or,ifthedefendantisnotanaturalperson,itsseat,itsplaceofincorporationoritsprincipalplaceofbusinessinthatState;(2) ifthedefendanthad,intheStateoforigin,atthetimewhentheproceedingswereinstituted,acommercial,industrialorotherbusinessestablishment,orabranchoffice,andwascitedthereinproceedingsarisingfrombusinesstransactedbysuchestablishmentorbranchoffice;(3) iftheactionhadasitsobjectthedeterminationofanissuerelatingtoimmovablepropertysituatedintheStateoforigin;(4) inthecaseofinjuriestothepersonordamagetotangibleproperty,ifthefactswhichoccasionedthedamageoccurredintheterritoryoftheStateoforigin,andiftheauthoroftheinjuryordamagewaspresentinthatterritoryatthetimewhenthosefactsoccurred;(5) if,byaw。
