GENERAL PROVISIONSSec.A69.001.AASHORT TITLE.This chapter may be cited as theJefferson and Orange County Pilots Licensing and Regulatory Act.AmendedbyActs2003,78thLeg.,ch.745,Sec.1,eff.June20,2003.Sec.A69.002.AADEFINITIONS.In this chapter:(1)AA“Board“meanstheboardofpilotcommissionersdescribed by Section 69.011.(2)AA“Consignee“meansaperson,includingamaster,owner, agent, subagent, firm, or corporation or any combination ofthose persons, who enters or clears a vessel at the office of thecollector of customs.(3)AA“Jefferson or Orange County port“ means a place inJefferson or Orange County into which a vessel enters or from whicha vessel departs and the waterway leading to that place from theGulf of Mexico.(4)AA“Pilot“ means a person who is licensed as a branchpilot or certified as a deputy branch pilot under this chapter.(5)AA“Pilotage rate“ means the remuneration a pilot maylawfully charge a vessel for pilot services.(6)AA“Pilotservices“meansactsofapilotinconducting a vessel through navigable water in this state and theports in which the pilot is licensed or certified as a pilot.(7)AA“Vessel“ means an oceangoing vessel.Added by Acts 2003, 78th Leg., ch. 745, Sec. 1, eff. BOARD OF PILOT COMMISSIONERSSec.A69.011.AACOMPOSITION OF BOARD.(a)The board of pilotcommissioners for all of the ports and private terminals located inJeffersonorOrangeCounty,orboth,iscomposedoffivecommissionersfromJeffersonorOrangeCountyappointedbythegovernor in the manner provided by Subchapter A, Chapter 63.(b)AAThe presiding officer of the board shall be selected bythe members of the board.Added by Acts 2003, 78th Leg., ch. 745, Sec. 1, eff. June 20, 2003.Sec.A69.012.AAPROHIBITEDINTEREST.Apersonmaynotbeamember of the board if the person has a direct or indirect pecuniaryinterestinapilotboatorbranchpilotinthebusinessoftheboard’s trust.Added by Acts 2003, 78th Leg., ch. 745, Sec. 1, eff. June 20, 2003.Sec.A69.014.AATERMSOFOFFICE.(a)Boardmembersservestaggered two-year terms of office.(b)AAAmemberholdsofficeuntilthemember’ssuccessorisappointed and qualified.Added by Acts 2003, 78th Leg., ch. 745, Sec. 1, eff. June 20, 2003.Sec.A69.015.AAJURISDICTIONOFBOARD.TheboardhasexclusivejurisdictionoverthepilotservicesprovidedinJeffersonorOrangeCounty,includingintermediatestopsandlanding places for vessels on navigable streams wholly or partiallylocated in the board’s jurisdiction.Added by Acts 2003, 78th Leg., ch. 745, Sec. 1, eff. June 20, 2003.2Sec.A69.016.AAADMINISTRATION;RULES.(a)The board shalladministerthischapterandmayperformanyactorfunctionnecessary to carry out its powers and duties under this chapter.(b)AAThe board may adopt rules to carry out this chapter.Added by Acts 2003, 78th Leg., ch. 745, Sec. 1, eff. June 20, 2003.Sec.A69.017.AADUTIES.(a)The board shall:(1)AAestablishthenumberofpilotsnecessarytoprovide adequate pilot services for each Jefferson or Orange Countyport;(2)AAestablish pilotage rates;(3)AAhearanddeterminecomplaintsrelatingtotheconduct of pilots;(4)AAmakerecommendationstothegovernorconcerninganypilotwhoselicenseorcertificateshouldnotberenewedorshould be revoked;(5)AAadopt rules and issue orders to pilots and vesselswhen necessary to secure efficient pilot services;(6)AAinstituteinvestigationsorhearingsorbothtoconsider casualties, accidents, or other actions that violate thischapter;(7)AAprovide penalties to be imposed on a person who isnot a pilot for a Jefferson or Orange County port and who pilots avessel into or out of the port if the person offered pilot servicesto the vessel;(8)AAestablish times during which pilot services willbe available;(9)AAacceptapplicationsforpilotlicensesandcertificatesanddeterminewhethereachapplicantmeetsthequalifications for a pilot;(10)AAsubmit to the governor the names of persons whohave qualified under this chapter to be appointed as branch pilots;and(11)AAapproveanychangesofthelocationsofpilotstations.(b)AAThe board may:(1)AArecommend the number of deputy pilots each branch3pilot may appoint under Section 69.038;and(2)AAmakeanyotherprovisionforproper,safe,andefficientpilotageunderthischapterandfortheefficientadministration of this chapter.(c)AATheboardmayassessagainsttheusersofpilotservices:(1)AAthe actual costs the board considers fair and justincurredinconnectionwithhearingsagainstanyapplicantorobjecting party;and(2)AAotherexpensesthatarenecessaryandpropertoenabletheboardtoeffectivelycarryoutthepurposes。
