本人授权华中科技大学可以将本学位论文的全部或部分内容编入有关数据库进行检索,可以采用影印、缩印或扫描等复制手段保存和汇编本学位论文保密□,在年解密后适用本授权书本论文属于 不保密□〔请在以上方框内打"√".学位论文作者签名：指导教师签名：.日期：年月日日期：年月日.华 中 科 技 大 学 硕 士 学 位 论 文.摘要.农民工作为一个特殊的名词,也作为一个特殊的群体,介于市民、农民,工人和农民之间,呈现出城市、农村双向的、复合的流动趋势近年来,大量农民进入城市务工,繁荣了城市的发展,减缓了农村的发展,城乡发展距离近一步拉大中央提出建设社会主义的新型农村规划,加大对农村建设的投入,促进城乡和谐发展随着新农村建设的推进,扩大了农村的就业和创业空间,吸引了大量的农民自主创业就业目前,有许多的研究者对农民创业的行为和政策支持进行了分析和探讨,但主要从社会学、经济学和管理学学科角度出发,而法学方面的研究相对较少本文力图从我国现有的法律制度出发,对农民创业的问题进行研究,共有四个部分第一部分是导论,阐述了农民创业的研究背景和研究意义第二部分首先界定了农民创业的涵义；其次分析了农民在创业领域、创业规模、创业主体方面具有的特点,为掌握当前创业农民的基本情况,制定促进创业的有效措施提供了依据；最后论述了农民创业法律制度促进的必要性,明确了法律角度研究的现实意义。

第三部分论述了农民创业法律制度促进的成效和问题本部分从中央和地方的税费优惠、小额贷款、创业培训法律制度方面分析了促进农民创业的成效和该法律制度存在哪些问题第四部分根据法律制度存在的问题,从完善反农民创业歧视的法律制度规定,创业融资、税收优惠、创业知识培训的法律制度,司法保障、政策监督问责机制等方面提出了促进农民创业法律制度完善的建议通过这些研究,力图进一步深入推动农民创业的法律研究,为制定促进农民创业的法律制度提供依据最后进行了总结和展望关键词：农民创业法制促进I.华 中 科 技 大 学 硕 士 学 位 论 文AbstractMigrant workers as a special term,Also as a special group,Between the public andfarmers, workers and farmers show the mobility trends of urban and rural. In recentyears, a large number of farmers bing in urban for prosperity and development of thecity, but Rural areas to slow down the development, urban and rural developmentdistance step forward pull. The Central Committee building a socialist new ruralplanning to increase investment in rural development, and promote the development ofurban and rural harmony. With the advance of the new rural construction, expandingrural employment and business opportunities have attracted a large number of farmersto return home to start their own businesses employment. At present, many researchershave analyzed and discussed the actions and Policy support of Farmer entrepreneurship.what research are from sociology, economics and management science disciplines, onlyfew studies of jurisprudence.This paper tries to proceed from China's existing legal system to study the issue offarmer entrepreneurship. The paper is made up of four components.The first part of the introduction set forth the background of farmers returninghome and significance of entrepreneurship.The second part, firstly, describing what farmer entrepreneurship is .Secondly,analyzing the characteristics of migrant workers returning home in the field ofentrepreneurship, venture size, the main business. This provides a fundamental basis forgrasping the basic situation the of migrant workers returning home, then developingeffective measures to promote entrepreneurship. Finally, discuss sing the necessity oflegal system to promote farmer entrepreneurial behavior and clearing practicalsignificance of legal point of view.The third part discussed how to promote the effects of farmer entrepreneurshiplegal system and what problems are.
