诉讼委托的代理合同中英文对照诉讼托付的代理合同中英文对比甲方：Party A:地址：Address:：Telephone:乙方：Party B:地址：Address:：Telephone No.:依据《中华人民共和国律师法》以及其他相关法律法规的规定，甲乙双方同意以下条款：According to ATTORNEY LAW OF THE PEOPLE’S REPUBLIC OF CHINA,and other relevant laws and regulations of P.R.China,Party A and Party B mutually agree to the following terms:一、托付事项commitment〔1〕甲方与W电讯有限公司之间诉讼案的二审或者申诉和判决后的执行；A.The second instance,or appeal of the litigation between Party A and W company.〔2〕全部与〔1〕条相关的诉讼、仲裁、上诉、执行程序直到终审和判决执行，包括判决金额的获得B.Other litigation,arbitration,appeals,enforcements and/or all proceedins relevant to the actions listed in Exhibit A until final judgmentand enforcement of judgement,including collection of judgment amount is finalized.〔3〕在合理范围内,诉讼和仲裁的策略最终打算，以及任何相关的诉讼事实，打算权在甲方。

在本协议有效期,乙方将敬重甲方的指示，除非该指示违背中国的法律C.Within reason,the final decision regarding strategy of litigation and/or arbitration,as well as any and all facts of the litigation,are at the full discretion of Party A.Pursuant to the terms of this Agreement,Party B shall follow theinstructions of Party A unless these instructions violate the law in the People’s Republic of China.二、代理费用及支付方式2.Payment of Fees2.1代理费用乙方依据本协议完成全部代理工作的代理费用由如下两局部组成：固定费用：人民币15万元整〔含税〕,作为乙方律师工作本钱费用在本协议签订后5日内一次性电汇至乙方指定帐户；乙方出具发票另行提成费用：乙方将依据本协议从本案最终执行回来的全部净收益中提取40%。

净收益的含义如下：来自本案的全部金额，减去已经支付的案件费用甲方扣除费用指的是从法院执行回款中扣除本案一审和二审的诉讼费以及法院执行费假如执行回的净收益少于已经支付的费用，双方根据如下安排：每一方都根据收益的比例安排比方,诉请金额为人民币100元，收益。
