    • 1、Supplier Social Responsibility and Business Ethics Agreement供應商社會責任與商業道德同意書Supplier Social Responsibility and Business Ethics Agreement總則 General 佳世達供應商/分包商及其分供應商(以下簡稱“供應商”)承諾所有企業活動均在國際和當地適用法律法規的框架內進行,公平競爭,誠信交易,嚴格遵守商業道德,積極履行社會責任,並遵守電子行業公民聯盟(Electronic Industry Citizenship Coalition, EICC)行為準則。 Qisda supplier/subcontractors and sub-supplier (hereinafter called “supplier”) promises that all the companys activities are conducted in accordance with applicable national and local laws, and shall compe

      2、te fairly, trade trustily, comply with business ethics strictly, execute social accountability positively, and comply with Electronic Industry Citizenship Coalition (EICC) Code of Conduct.環境 Environment 供應商應當出具ISO 14001證書,或相關計畫以明示其正為獲得該證書而努力,或者擁有可操作性的環境管理體系。如以上均不具備,至少應該提供確實證據,以證明其環境狀況的持續性改善。 Supplier shall have ISO 14001 certification or a plan to become certified. Alternatively supplier must provide a practicable environmental management system or at least demonstrate explicit and suitable evid

      3、ences which show continual environmental improvement. 供應商應當與本公司簽署相關的禁用物質聲明。 Supplier shall sign relevant banned substance declaration with Qisda.健康與安全 Health and Safety 供應商應當為員工提供安全與健康的工作場所和環境,並承諾遵守OHSAS 18001之要求。對於危險工作區域、有害材料或危險產品應當加以明顯標示。 Supplier shall provide healthy and safe work sites and circumstances for workers, comply with requirements of OHSAS 18001, and identify and notice hazardous work areas, harmful materials and dangerous goods with distinct marks. 供應商應當定期對健康安全風險進行評估,對於預期風險有相應地管理

      4、計畫或安全管控措施,以及緊急救助程序。 Supplier shall assess health and safety risks regularly, and shall have corresponding management plan, safety control measures and emergent response procedures for anticipated risks. 供應商應當對所有員工一視同仁地宣導和教育,以確保員工知悉公司的健康安全計畫、風險和救助程序。 Supplier shall train and communicate with all workers impartially to ensure their understanding of Health and Safety plans, risks and emergency procedures. 供應商應當定期對健康安全計畫、程序、相關設施進行評估和改進。 Supplier shall assess and improve Health and Safety plans, proc

      5、edures and relevant facilities regularly.勞工 Labor 供應商應當承諾保障作業同仁的人權安全,讓員工受敬重並維持尊嚴,並承諾遵守SA 8000及EICC行為準則之要求。 Supplier shall promises to protect the rights of workers, to treat them with dignity and respect, and to comply with the requirements of SA 8000 and EICC Code of Conduct.自由選擇職業 Freely Chosen Employment 供應商承諾不使用任何形式的強迫勞工、奴役及販賣人口。供應商不得扣留人員的部分薪資、福利、財產或文件檔案。所有工作均應當出於自願,員工擁有自由離職或終止僱傭關係之權利。 Supplier commits to no forced labor of any form, no slavery, and no human trafficking. Supplier should not

      6、withhold any part of any personnels salary, benefits, property or documents in order to force such personnel to continue working. All work must be voluntary and workers shall be free to leave work or terminate their employment. 禁止對員工進出入工作場所作出不合理限制,亦不得約束勞工在工作場所內走動的自由。 There should be no unreasonable restrictions on workers freedom of movement in the facility in addition to unreasonable restrictions on entering or exiting company-provided facilities. 供應商不得要求員工繳交政府頒發的身份證、護照等其他證件作為雇用的條件。不得要求員工繳納押金或其

      7、他同等形式作為雇用的條件。 Supplier must not demand workers hand in ID cards, the passport or any other credentials authorized by the government as the prerequisite for employment, or require workers submit deposits or any other equivalency as the prerequisite for employment. 青年勞工 Young Workers 供應商承諾不雇用童工,未滿18歲之青年勞工不得從事可能危及其健康或安全之工作。 Supplier promises not to employ child labors. Young workers under the age of 18 shall not perform work that is likely to jeopardize their health or safety. 供應商應當具有相關程序文件,以確保一旦發現

      8、公司使用童工,應有相應地拯救措施。 Supplier shall have relevant procedures and documents to ensure corresponding rescue measures when child labors are found. 工時與薪資 Working Hours and Wages 供應商應當積極努力確保其員工工作時間及休息日符合EICC行為準則、SA8000和當地適用的法律規定。加班基於自願原則,不強迫員工加班。 Supplier shall ensure that the situation of working hours and rest day is compliance with EICC Code of Conduct, SA8000 and applicable local laws by active work. Overtime work is voluntary and without force or coercion. 供應商承諾其薪酬政策符合當地所有法律規定。員工薪酬不低於當地最低工資標準,加班薪資應

      9、高於常規薪資,且禁止以扣除薪資作為紀律處分之手段。 Supplier promises its compensation policy is compliance with all local laws. Workers salaries shall be not less than the local minimal salary standard and workers shall be compensated for overtime at pay rates greater than regular hourly rates. Deductions from wages can not be permitted as disciplinary measure.人道待遇與不歧視 Humane Treatment and Non-Discrimination 供應商應承諾員工免受苛刻及不人道之待遇,包含性騷擾、性侵犯、精神或身體處罰或口頭辱罵。 Supplier should be committed to be no harsh and inhumane treatment, including any sexual harassment, sex abuse, corporal punishment, mental or physical coercion or verbal abuse of workers. 供應商應承諾員工免受騷擾以及非法歧視。公司不得因種族、階級、膚色、年齡、性別、性傾向、性別認同及表達、國籍或地域、殘疾、懷孕、信仰、政治立場、團體背景、退伍軍人身分、基因信息或婚姻狀況等在招聘及實際工作中歧視員工。 Supplier should be committed to employees free of harassment and unlawful discrimination. Supplier shall not engage in discrimina
